Project Description:
The applicant proposes to clear vegetation and place fill in existing recharge basins located within the 100-foot adjacent area of a NYS-regulated freshwater wetland (FWW# R-4). These activities are proposed in association with the construction of a single-family dwelling located outside of the adjacent area and beyond Freshwater Wetlands Act jurisdiction. The proposed limits of clearing are approximately 46 feet upland of the freshwater wetlands boundary. The existing retention basins are proposed to be filled and regraded with approximately 1050 cubic yards of clean fill. This area will be seeded with native upland species and allowed to revert to natural. A permanent fence is proposed to be installed such that 85% of the freshwater wetlands adjacent area within Freshwater Wetlands Act jurisdiction remains natural. The property is within 1.5 miles of acoustically detected summer occurrence of northern long-eared bat (Myotis septentrionalis). To avoid an incidental take of a threatened species, tree clearing at this site would only be authorized to be conducted between November 30 and March 1 of any calendar year. State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
