RESOLUTION CALLING PUBLIC HEARING REGARDING A CAPITAL IMPROVEMENT TO THE EXISTING FACILITIES OF THE RIVERHEAD WATER DISTRICT FOR A PROPOSED LATERAL MAIN REPLACEMENT AT 205 OSBORNE AVENUE, RIVERHEAD, NEW YORK
Councilman Hubbard offered the following resolution,
which was seconded by Councilman Beyrodt Jr.
WHEREAS, a petition has been filed by the owner/developer of the 205 Osborne Avenue – Mixed Use Development, requesting that the proposed facility to be located at 205 Osborne Avenue, Riverhead, New York be served by the Riverhead Water District; and
WHEREAS, the proposed facility is located within the existing boundaries of the Riverhead Water District; and
WHEREAS, a map and plan dated August 2022 has been prepared by H2M, consulting engineers to the Riverhead Water District, detailing the necessary measures and costs associated with replacing the lateral mains at the development site; and
WHEREAS, the property is located in Downtown Riverhead at the intersection of Osborn Avenue and Court Street. The proposed extension comprises a five-story mixed-use building of approximately 45,000 square feet (sf) to replace an existing one-story medical office facility; and
WHEREAS, the map and plan are available for review and inspection at the Office of the Riverhead Town Clerk, 200 Howell Avenue, Riverhead, New York, during normal business hours; and
WHEREAS, said map and plan call for a water main with the total length of approximately 850 feet including three (3) new fire hydrant assemblies, and one (1) four-inch domestic water and one (1) six-inch fire service lines complete. The mixed-use building’s domestic and fire service line will consist of necessary valving, meter, vault, and piping up to the property line. The cost to extend these proposed facilities shall be solely the responsibility of Owner. The estimated project cost to implement the replacement of water main to serve the 205 Osborn Avenue development is $509,000. These costs also include engineering, permitting, construction observation, legal, administration and contingencies, excluding District Key Money Fees; and
WHEREAS, as stated above, all costs associated with this lateral shall be borne by the petitioner and the petitioner will be required to pay key money fees for water usage. The total increased water use for the site is 8,815 GPD for the proposed development. Using the Riverhead Water District Key Money Assessment Method, this development shall be assessed a Key Money Fee of $9.10 per gallon. However, in assessing key money fees the developer is due a credit for the pre-existing medical office space on site. The credit due to the developer for the 4,533 sf of existing medical office space which has or shall be demolished is 453 gallons per day. Therefore, the total Key Money Fees for the proposed development is 8,362 gpd which equates to a Key Money Fee of $76,094 [(8,815-453 gallons) x $9.10 / gallon]. In addition, the property is to be taxed the standard Water District tax rate as it is located within the current District Boundary; and
WHEREAS, the Town Board desires to call a public hearing on the adoption of a final order concerning the petition.
NOW THEREFORE BE IT RESOLVED, that the Town Clerk be and is hereby authorized to publish and post a Notice of Public Hearing to be held on the 20th day of September, 2022 at 6:05 p.m. at the Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, to hear all interested persons with regard to the adoption of a final order concerning the petition to construct/replace a lateral water main extension as described in the preambles hereto to provide water service to the proposed Mixed Use Development, to be located at 205 Osborne Avenue, Riverhead, New York, New York, at the sole cost of the developer and at no cost to the District and the payment of key money pursuant to the Riverhead Town Code; and
BE IT FURTHER RESOLVED, that the Town Clerk be and is hereby authorized to publish and post a copy of this resolution in full in the September 15, 2022 edition of The News Review; and be it further
BE IT FURTHER RESOLVED, that all Town Hall Departments may review and obtain a copy of this resolution from the electronic storage device and if needed, a certified copy of same may be obtained from the Office of the Town Clerk.
