PLEASE TAKE NOTICE that a public hearing will be held before the Town Board of the Town of Riverhead at 200 Howell Avenue, Riverhead, New York on the 21st day of June, 2022, at 6:15 p.m. to consider a local law to amend Chapter 301, Article I and Article XXIII of the Riverhead Town Code.
Be it enacted by the Town Board of the Town of Riverhead as follows:
Article I § 301-3 Definitions; word usage.
ANAEROBIC DIGESTER
Any facility which accepts, treats or processes wasterwater treatment sludges, biosolids, manure, food waste, fats, oils, greases, energy cropss, glycerin, silage or any similar material for the purpose of producing biogas and digestate.
Article XXIII §301-114 Uses
In the Ind A Zoning Use District, no building, structure, or premises shall be used or arranged or designed to be used, and no building or structure shall be hereafter erected, reconstructed, or altered, unless otherwise provided in this chapter, except for the following permitted uses or specially permitted uses and their customary accessory uses:
Permitted uses:
Vocational schools.
Warehouses.
Lumberyards.
Automobile body and fender repair shops.
Agricultural production.
All non-nuisance industrial uses are permitted in the Ind A Zoning Use District, with the exception of the following uses, inclusive of, but not limited to, which shall be prohibited:

Building trade shops.

Special permit uses:
Gas stations, on parcels with frontage on a highway or major arterial street.
Wholesale businesses.
Dog and horse training and boarding facilities.
Storage and distribution facilities of nontoxic gases, as defined in § 301-3.

Accessory uses. Accessory uses shall include those uses customarily incidental to any of the above permitted uses or specially permitted uses when located on the same lot. Specifically permitted are the following:
Outdoor storage, limited to 30% of the parcel area or two acres, whichever is less, suitably screened pursuant to Article XLV, Supplementary Use Regulations, of this chapter.
