Public Notice: Town of Riverhead — public hearing to amend chapter 301 “Zoning and Land Development”

TOWN OF RIVERHEAD 

NOTICE OF PUBLIC HEARING

PLEASE TAKE NOTICE that a public hearing will be held before the Town Board of the Town at Riverhead at Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, on the 18th day of August 2020 at 2:05 o’clock p.m. to amend Chapter 301 entitled, “Zoning and Land Development”, Part 3 thereof entitled, “Supplementary Regulations”, Article XLV thereof entitled, “Supplementary Use Regulations”, Section 301-231 thereof entitled, “Off-street Parking” of the Riverhead Town Code.

PLEASE TAKE FURTHER NOTICE, that in accordance with the directive of Executive Order 202.1 issued by Governor Andrew M. Cuomo, the meeting will be held without in-person attendance by the public. Instead the public will have an opportunity to participate during the Town Board meeting using Zoom to offer their comments and/or questions regarding this public hearing before the Town Board.  Zoom sign in credentials will be posted prior to the Town Board meeting. As always written correspondence is accepted by the Town Clerk’s Office. 

BE IT ENACTED by the Town Board of the Town of Riverhead as follows:

Part 3 Supplementary Regulations

Article XLV Supplementary Use Regulations

§ 301-231 Off-street parking. 

N.  Driveways and parking. 

  • Legislative intent. In order to maintain an appropriate visual quality for residential properties, preserve property values, protect neighborhood character and safeguard quality of life, certain standards shall apply as specified herein in the Residence A-40 (RA-40) Zoning Use District, Residence B-40 (RB-40) Zoning Use District, Residence A-80 (RA-80) Zoning Use District, and Residence B-80 (RB-80) Zoning Use District.

(a)  The amount of front yard area consisting of asphalt, gravel, stone or dirt or other non-vegetative material, to be used primarily for the parking of vehicles, shall not exceed 35% of the area of the front yard.

(b) The parking of vehicles in the front yard area is restricted to that portion consisting of asphalt, gravel, stone or dirt or other non-vegetative material. The parking of vehicles in the front yard area is prohibited when all four tires of a vehicle are placed on grass or other vegetative material. This prohibition shall not apply if inclement weather conditions (such as flooding or snow accumulation) render it impracticable or impossible to comply therewith.

(c) Where applicable, on a parcel with frontage on more than one street, the portion of the lot comprising a second front yard cannot be used for the area consisting of asphalt, for the parking of vehicles, except in those cases where said area is less than 35% of the total area for all front yard.

(d) Penalties for the parking of vehicles in front yard areas. Failure to comply with the provisions in this section shall be designated as violations and shall be punishable as follows:

(i) For the first conviction: by a fine of not less than $100.00 nor more than $250.00;

(ii) For the second conviction committed within a period of two (2) years: by a fine of not less than $250.00 nor more than $500.00; and

(iii) For a third and each subsequent conviction committed within a period of two (2) years: by a fine of not less than $500.00 nor more than $1,000.00.

(e) The penalties provided for at §301-320 shall not be applicable to this §301-231(N).
