The buyer's obligation to close on the $40 million deal isn't firm until its 'due diligence' opportunity is ended.

“The board basically excused misbehavior by narrowing its focus and did not respond to the core of our complaint," according to civic coalition that filed the complaint, which Councilwoman Jodi Giglio said had "no basis — no facts, no nothing to back it up."

The Riverhead Town Board will vote on the Calverton Aviation and Technology “qualified and eligible sponsor” application on Wednesday evening, Nov. 7 at a special meeting to be convened at 6 p.m.

In a decision dated Oct. 24 and received by town board members today, the Riverhead Board of Ethics found that Giglio did not violate the Riverhead ethics code in taking a private meeting with the applicant’s representatives

A Triple Five affiliate closed on the purchase of the 105-acre Dowling College campus in Shirley Sept. 21. A vote on the proposed sale of the 1,643-acre Calverton site remains stalled as town board members continue to wait for a decision by the town ethics board on whether one member has a potential conflict of interest requiring recusal.

It's still unknown whether a board majority will find the latest submission by Triple Five adequate for making a decision on the sale of Riverhead's remaining vacant acreage at the Calverton Enterprise Park — even as the board continues to wait for some word from the Riverhead ethics board on the complaint about Councilwoman Jodi Giglio's private meeting with the applicant.

The company looking to buy more than 1,600 acres of vacant land at the Calverton Enterprise Park submitted additional financial information, a concept plan and an economic benefits analysis to the Town of Riverhead today.

Riverhead Town officials have agreed to review the additional financial information Triple Five Group has offered to provide at the town's request. 

The town board has not had a chance to sit down and review the response together because it arrived late in the day on Friday, Supervisor Laura Jens-Smith. “We need to determine if what they say they’ll provide will be satisfactory.”

The town had set a deadline of 4 p.m. Wednesday for a response to its demand for financial statements from Triple Five. The town board is now considering a request to extend the deadline by a week.
