Repeat felony DWI offender sentenced to up to 7 years in prison

A 36-year-old man was sentenced Tuesday to 2⅓ to seven years in prison after a Suffolk County jury convicted him of driving while intoxicated in Southampton, the Suffolk County District Attorney’s Office said.

Pablo Aguilar-Alvarez’s conviction was his fourth felony DWI conviction in 10 years, according to prosecutors. He also has a prior misdemeanor DWI conviction.

The charges stemmed from a Nov. 29, 2025, traffic stop. Prosecutors said Aguilar-Alvarez drove with his girlfriend to a gas station at Flanders Road and Longneck Boulevard, where she asked a clerk to call 911. Southampton Town police later located the vehicle and saw its driver fail to stop at a stop sign and cross the double yellow line, the district attorney’s office said.

Prosecutors said Aguilar-Alvarez exited the passenger side after the vehicle stopped. A breath test measured his blood alcohol content at 0.17 percent, according to the district attorney’s office.

A jury convicted him Aug. 7 of two felony DWI counts and a misdemeanor count of aggravated unlicensed operation of a motor vehicle. The court released him pending sentencing and barred him from driving, despite prosecutors’ request that he be held, the district attorney’s office said.

On Aug. 17, district attorney’s investigators stopped Aguilar-Alvarez near Main Street in Riverhead and accused him of driving without a valid license. Federal immigration authorities subsequently detained him and returned him to Suffolk County for sentencing, according to the district attorney’s office.

The district attorney’s office said immigration authorities have lodged a detainer seeking custody of Aguilar-Alvarez, who is a Salvadoran national, after he serves his sentence. The D.A.’s office also said records show he was deported in 2024 and is in the United States without legal authorization.

Aguilar-Alvarez was represented by the Legal Aid Society, the district attorney’s office said.
