PUBLIC NOTICE
Pursuant to Section 267 of the Town Law a Public Hearing will be held by the Zoning Board of Appeals of the Town of Riverhead, Suffolk County, New York on March 22, 2012 at the Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York not before the time shown below on each of the following appeals:
7:15 p.m., prevailing time, Appeal No. 12-04, the appeal of Strong Oil Company, Inc. 841 Old Country Road, Riverhead, New York, for an interpretation to Chapter 108, Section 108-266 and 108-51 of the Code of the Town of Riverhead, whether a legally mandated cessation of a gasoline sales operation constitutes an abandonment of the existing non conforming use; or in the alternative, requesting a use variance to allow a gasoline sales operation and the ordinary and customary accessory uses thereto.
7:20 p.m., prevailing time, Appeal No. 12-12, the appeal of Kay Cee Corp, Kyle Conklin, 656 West Main Street, Riverhead, New York, for variances to Chapter 108, Section 108-278 of the Code of the Town of Riverhead, requesting a permission to retain a non-conforming residence on subject premises and to re-establish a prohibited outdoor auto storage use on subject premises, and Section 108-64.1, requesting permission to provide a buffer area from a residential use of 5 feet instead of the required 10 feet and to provide a front yard buffer from the State right-of-way of 3 feet instead of the required 25 feet.
7:25 p.m., prevailing time, Appeal No. 12-13, the appeal of Mark & Lisa Cardone, 2314 Sound Avenue, Baiting Hollow, New York, for variances to Chapter 108, Section 108-8 C of the Code of the Town of Riverhead, requesting permission to erect/maintain a horse run in structure on a parcel without a permitted primary use, and 108-10.1, aforementioned structure having 16.9 feet from the front property line, all previously conditionally granted in Appeal No. 09-68.
7:30 p.m., prevailing time, Appeal No. 12-14, the appeal of Elizabeth Waugh, 724 Sound Shore Road, Riverhead, New York, for variances to Chapter 108, Section 108-10.1 and Section 108-64 of the Code of the Town of Riverhead, requesting permission to erect a modular/prefabricated single family dwelling with a front porch having a front yard depth of 40 feet instead of the required 50 feet, a rear yard depth of 39.4 feet instead of the required 60 feet, side yard widths of 10.8 feet each side instead of 25 feet, having a combined side yard width of 21.6 feet instead of the required 55 feet, and to provide for 23.7% impervious surface instead of the permitted 15%.
7:35 p.m., prevailing time, Appeal No. 12-15, the appeal of Philip Swotkiewicz, 147 Washington Avenue, Jamesport, New York, for variances to Chapter 108, Section 108-64 and Section 14.1 of the Code of the Town of Riverhead, requesting permission to install a modular/prefabricated single family dwelling having a rear yard depth of 41 feet instead of the required 60 feet, having a side yard depth of 22 feet instead of the required 25 feet and having a combined side yard width of 52 feet instead of the required 55 feet.
7:40 p.m., prevailing time, Appeal No. 12-16, the appeal of Catherine Lanieri, Meritage Realty, LLC, for variances to Chapter 108, Section 108-278 of the Code of the Town of Riverhead, requesting use variances for non permitted motor vehicle repair shop, contractor/building trade shop and industrial uses.
Any person desiring to be heard on the above mentioned appeals should appear at the specified time and place.
