PUBLIC NOTICE
Pursuant to Section 267 of the Town Law a Public Hearing will be held by the Zoning Board of Appeals of the Town of Riverhead, Suffolk County, New York on June 28, 2012 at the Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York not before the time shown below on each of the following appeals:
7:15 p.m., prevailing time, Appeal No. 12-30, the appeal of RGR Associates, 5 de Mayo Restaurant, 3725 Middle Country Road, Calverton, New York, for variances to and/or relief from the provisions of Chapter 108, Section 108-274, requesting permission to re-establish a previously existing non-conforming use as a restaurant, Chapter 108, Section 108-56 C (3) (d) requesting permission to re-establish a pre-existing non-conforming freestanding sign having a distance of 10 feet from the front property line instead of the permitted 15 feet and having a distance of 15 feet from the side yard property line instead of the permitted 25 feet, and Section 108-56 C, requesting permission to erect a second primary free standing sign.
7:20 p.m., prevailing time, Appeal No. 12-31, DND Land Associates, Northville Commerce Park, Old Country Road & Northville Turnpike, Riverhead, New York, for variances to and/or relief from the provisions of Chapter 108, Section 108-271, requesting permission to provide for 68.78% of impervious surface instead of the permitted 60%, an interpretation to Chapter 108, Section 108-271 B to determine whether the front of lot also includes the side street of Northville Turnpike when calculating the front of lot landscaping open space area requirement, an area variance to allow for less than 20% landscaped open space area of the lot area at the front of the lot, an interpretation to Chapter 108, Section 272 B to determine whether 10% parking lot landscaping must be within the parking lot or can include areas adjacent to the parking lot (such as screening and buffering plantings along the boundary of residential uses), or in the alternative, an area variance to include those adjacent areas as parking lot landscaping.
Any person desiring to be heard on the above mentioned appeals should appear at the specified time and place.
Zoning Board of Appeals work session begins at 6:45 P.M. in the office of the Town of Riverhead Planning Department.
