A Nassau County company that purchased a 5 ⅓ acre site on Middle Road in Calverton is seeking site plan approval for cannabis growing and processing. 

1458 Middle Road LLC of Syosset purchased the former Walter Kobylenski residence on the north side of Middle Road, just west of Deep Hold Road, in June. The company paid $1.25 million to the Walter Kobylenski Trust, according to county records.

The company submitted a site plan application to the town planning department seeking approval to raze two barns on the property, build a greenhouse, a parking lot and erect a deer fence. 

Riverhead Town Senior Planner Greg Bergman, who is also the town’s zoning officer, advised the applicant that the plan requires two variances from the Zoning Board of Appeals. The site is in the Agricultural Protection Zone (APZ). The code limits fence height to six feet and impervious surfaces to 15%. The plan as submitted calls for an eight-foot deer fence and impervious surface coverage of 24%.

The company submitted a variance application to the ZBA, requesting relief from the requirements of the code for fence height and impervious surface coverage. 

A hearing before the Riverhead ZBA is scheduled for Thursday evening at 6 p.m. at Riverhead Town Hall. 

The plan also requires site plan approval from the Riverhead Planning Board.

Growing and processing cannabis in New York State requires a cultivator license issued by the Office of Cannabis Management. 

A cultivator license under the New York State Marihuana Regulation & Taxation Act authorizes the licensee to acquire, cultivate, harvest, dry and trim cannabis at the licensed premises. A cultivator licensee can sell cannabis from the licensed premises to duly-licensed processors only — not to the general public. State regulations prohibit cultivator license holders from holding adult use retail dispensary licenses and from having any interest in a retail dispensary.
